At least two North Dakota businesses and their employees have challenged the legality of President Biden's use of OSHA's "emergency temporary standard" that would force businesses with over 100 or more employees to get vaccinated.  According to Breitbart a petition has been filed with the United States Court of Appeals.

The two businesses are both located in Bismarck Mandan.  DTN Staffing has more than 400 employees in Mandan and Miller Insulation in Bismarck has nearly 400 employees.  DTN provides staff for the healthcare industry.  They provide staffing to the upper midwest including Montana, North Dakota, South Dakota, Minnesota, and Iowa.  Miller Insulation is an industrial, commercial, residential, and oil field insulation company.  Miller insulation is a 100% employee-owned company.

The business lawsuits are in addition to ones filed by several states attorneys general, including North Dakota.  In the article, the businesses point out that Biden's OSHA mandate is irrational.  Under the mandate only the unvaccinated have two get tested weekly and have to wear a mask at work.  That doesn't take into account that employees who have already had COVID-19 where reinfection is highly unlikely.  Meanwhile, employees who are vaccinated can still get COVID-19 and spread it, do not have to wear a mask.  The two businesses call it "complete nonsense."

According to the Washington Post, the 5th circuit has halted the Biden OSHA vaccine mandate.  So, for now, it goes to courts and we'll see how this all shakes out.  Meanwhile, in Austria, they are trying to force the unvaccinated to go into lockdown.  You can read about that here
