Drinking and driving is a serious offense and something that people are arrested for everyday. However, what do you do when you've been pulled over and arrested for a DUI, even though you haven't consumed a drop of alcohol? Ask retired firefighter Jessie Thornton.

Thornton was pulled over and arrested recently in Surprise, AZ. When the cop came up to talk to Thornton, he noticed that Thornton's eyes were bloodshot, which the officer connected to him being under the influence. Thornton claimed he had just finished swimming at a local gym, but the police officer didn't care and began running Thornton through field sobriety tests.

Thornton completed the tests, though he was still handcuffed and hauled into jail on a DUI charge. While at the police station, a breathalyzer test conducted on Thornton revealed that he had a 0.00 BAC reading, meaning there were no alcohol or drugs in his system. A drug recognition expert also tested Thornton and said there was no reason why Thornton should've been arrested.

Thornton was released to his wife and has now hired a lawyer to sue the city of Surprise for $500,000. He claims this was a case of being arrested for "DWB...Driving while black."
